LANSING – The Michigan Association of Chiropractors’ (MAC) Board of Directors and Legal Affairs and Insurance Committees are committed to taking aggressive legal action against any and all health plans that unlawfully discriminate against doctors of chiropractic and their patients. As a result of this aggressive legal action, the MAC recently secured two critical, hard-fought victories.


“These wins send a very strong message to Michigan insurers,” said MAC President Kirk Steketee, DC. “Doctors of chiropractic will continue to fight for our right to practice and the rights of our patients to receive chiropractic treatment.”

In early July, Michigan Insurance Commissioner Linda Watters declared Blue Cross Blue Shield of Michigan’s (BCBSM) Healthy Blue insurance options unlawful and ordered BCBSM to withdraw them from the market. The Healthy Blue policies excluded doctors of chiropractic from performing physical medicine modalities and other services within Michigan’s chiropractic scope of practice.


Michigan law authorizes the commissioner to disapprove any certificate that contains provisions that are “unjust, unfair, inequitable, misleading, deceptive, or which encourage misrepresentation of the coverage.” Watters ruled that a certificate that discriminates against a class of health care providers is “unfair” under this law. In other words, once BCBSM offers coverage for a particular medical service, it may not exclude a class of providers from being paid for that service, so long as the provider is authorized by law and professional license to administer that service.


Furthermore, Watters noted that Blue Cross may not exclude spinal manipulative therapy from their coverages unless the exclusion is equally applied to all provider groups. This means that policies cannot discriminate against one provider group while allowing other providers to perform the excluded service.


Finally, Watters stated that, to the extent DCs are permitted by scope and licensure to perform physical therapy, they must be treated in the same manner as other providers
authorized to provide physical therapy.

I have a personal question to ask you. Do you currently suffer from "E.D"? I am sure that you have seen reference to this malady on television commercials. Do you have the symptoms of E.D.? The E.D. that I am referring to is slightly different from the one shown on TV. Even females can suffer from my form of E.D. The E.D. I am referring to is Economic Dysfunction. Economic Dysfunction knows no gender. It is an equal opportunity dysfunction for people of all ages, nationalities, and sex. All can be afflicted equally. It is a hideous malady and can wreck a marriage not only in the bedroom, but in every room in the house!

E.D. affects us all at some point in our lives. I am sure that you can remember suffering from E.D. when you, very early on in life, had to make the decision whether to buy that candy or save your money for that big ice cream. Decisions like that are not easy and they drive us to E.D. The ways we can fall prey to E.D. go on and on; but the purpose of this article is not to bring up these cruel memories, it’s, rather, to show you a way to stop suffering from this hideous malady. It is time to let go and begin anew with a fresh outlook on life and start enjoying the pleasures of a world free of E.D.

Where do you begin? Let’s start with your bank accounts: one of the basic sources of E.D. A basic rule to remember is that banks are not your friend. They like to see you suffering from E.D. and they can take a mild case of it and turn it into an epidemic that can run rampant through your family. Yes, even your kids can catch it from you.

How much of your cash does your bank hold for ransom? Yes, I said ransom. They hold your cash until you pay the ransom. That ransom is usually referred to as the fees that you pay the bank. You can never get your money out without paying more in fees than what they are paying you in interest. It is time to really review and get that cash liberated.

How, you ask? Armed with the information on what you are paying, it is time to have a chat with your bank and tell them that this is "totally unacceptable." The excessive fees must go, as well as the hold on all deposits and the charges for checks, etc. It is time! You will be amazed how quickly they will reduce or totally eliminate those fees and charges.

You need to move most of your money out of the bank and get those dollars to work for you earning a decent rate of return. I am a believer in having a "cash fund," but not at the bank. Check out what money market accounts are paying. This is a good place to park cash. Every mutual fund family has a money market account and they are all paying more than what the banks are paying.

Want to know another source of E.D.? Your insurance portfolio. All those policies that you have on your home, cars, equipment, jewelry, office, malpractice, disability, life—all of them are good breeding grounds for E.D. Your agents just love to see you suffering!

Pull all those policies out and try to make heads or tails out of them?

NO! Call your agent and tell them you need a summary of what you have. Do you have everything covered that should be covered? Are you really "insurance poor," or is it that you are premium poor? Maybe it is time to see if some "deductibles" can save you some money.

Do you really have the best insurance for you? You need to be able to answer that question. When you can, the symptoms of E.D. will start to just fall away.

Got a retirement plan? Ever feel E.D. when the subject comes up? If so, it is time to get control of this part of your planning as well. It is time now; so do it! Time to stop suffering and get on with your life.

E.D. can be brought on by lots of things: loans, debt, investments, etc. We have just taken a look at two of the most hideous sources. If you can deal with these two, you are well on the way to curing your problems and living a life free of the symptoms of E.D. Do this, and you can face the world again with a smile on your face.

Last year, the Office of the Inspector General (OIG) of the U.S. Department of Health and Human Services (HHS) stated that about 57 percent of all payments to Doctors of Chiropractic in 2001 did not meet the coverage criteria. With this finding, commercial carriers are now auditing and demanding refunds which, in turn, cause the doctors to become financially distraught.

When a patient walks through your clinic doors, what goes through your mind? Do you say to yourself, "Oh great, this is going to be easy because this patient is a CASH patient!" or, "Oh no, this is going to be a lot of work with taking notes because this is a personal injury or workers compensation patient."

Most chiropractors believe that their notes should be more expansive for a personal injury or workers compensation case. This just isn’t true unless, of course, you’re not taking proper notes on your cash and commercial insurance patients in the first place. The notes that you take with your personal injury patients and workers compensation patients are the same as any other patient, with the exception that you may want to be choosier with your diagnosis and your treatment plans should have some well-defined GOAL in mind.

Your CASH patient needs to have notes taken on them as well because, if for no other reason and if you read this article no further, then let me state this, "Your CASH patient can sue you just as easily as your third party insurance patient!!"

Another thing that you should take away from this article is the fact that medical necessity does not come from your SOAP notes. Medical necessity comes from the diagnostic tests that you perform. The daily SOAP notes are only intended to state what happened that day. According to the federal government (Medicare Carriers Manual December 1999. section 2251.2), the particulars that should be included in the SOAP notes are shown for the initial and subsequent visits in Tables A and B respectively.

The above examples would allow me to get paid at a Detailed E/M Level for my initial note, and the subsequent visit would be paid in full. These two notes would allow any doctor to step into my clinic and be able to treat the patient in a professional manner by being able to administer the treatment without having to ask the patient to describe what treatment they receive.

When I am teaching the Evidence Based Chiropractic Seminar Series, the one question that I am consistently asked is what I would consider the best and most appropriate SOAP note system. What I can tell you is that treatment/travel cards are not notes and they should not be used as such. Some practice management consultants teach a treatment card SOAP note system and only that. This is not correct. You want to use a system the insurance industry understands; after all, they are the ones holding your checks. So use what they are used to and understand.

The best SOAP note system is dictation. Dictated notes are the best note system for any practice. They are legible and they don’t sound canned. However, the largest drawback with dictation is the cost, as insurance reimbursements have not kept pace with inflation, and the price of dictation is increasing and becoming less affordable. My personal recommendation for dictation software is Dragon NaturallySpeaking. I use this software for my letters and even this article. It takes about fifteen minutes to get you up and running and the headset and microphone that come with it are perfect. The only thing that I don’t like is that I have to keep a number of MS word files on my computer and it is a small hassle in organizing the patient notes.

The only recommendation that I make for software is DC Powernotes. This is the most supreme software for Chiropractic SOAP notes anywhere. I like the fact that you can customize the heck out of it. The more you use it, the faster you become in creating a note. I love how it organizes the notes and that you can print off a single note or the entire record in a matter of mouse clicks. It also contains a radiographic report writer as well. The notes do sound a bit canned, after reading an entire record; but they are still notes and they do explain what happened that day. I have never had a problem with the use of DC Powernotes in a legal situation or otherwise. I have actually been complimented on the thoroughness of the DC Powernotes from auditors.

So, don’t get caught with your pants down around your ankles in the SOAP note department. Take pride in your notes. Your notes are a refl ection of your practice. If your notes are sloppy and illegible, it reflects poorly on you. Poorly written notes make you look unorganized and you become an easy target for audits and the witness stand in a legal situation. If they are well-written, legible, with concise statements, you look organized and less likely to be hassled regarding the specifics of the notes. There is no short cut to proper note taking.
